Administrative Instruction (MJ)—No. 03/2019 on Licensing Mediators in the Republic of Kosovo

In December 2019, the Ministry of Justice adopted the Administrative Instruction on Licensing Mediators in the Republic of Kosovo, with the purpose of regulating and determining the procedure for licensing the candidates who are certified by the Minister of Justice for mediators in the Republic of Kosovo. In this regard, the AI includes provisions regarding the licensing decision; provisions leading to suspension and revocation of licenses; recognition of foreign mediators and the administrative criteria that must be met by any foreign citizen to mediate in the Republic of Kosovo, among others. In line with Law No. 06 / L-009 on Mediation, the AI states that “a foreign citizen who is a licensed mediator in his country may file an application to mediate in the Republic of Kosovo in individual cases and under the conditions of reciprocity, after obtaining the prior consent of the Ministry of Justice, in accordance with article 25 of the Law” (Article 6, paragraph 1).
